These Terms of Service ("Terms") apply to all individuals and entities ("Customer," "you," or "your") who request towing or roadside assistance services from Towing Asheville ("Company," "we," "us," or "our") or who use our website at towingasheville.com. By requesting service by phone or submitting an inquiry through our website, you agree to these Terms.

Towing Asheville is a locally owned and operated towing company based in Asheville, North Carolina. Our services are provided throughout Buncombe County and, by arrangement, in surrounding areas and for long-distance transport.

When you call to request towing or roadside assistance and we confirm dispatch, you are authorizing us to perform the requested service and agreeing to pay the quoted price upon completion. Verbal authorization by phone constitutes a valid agreement for service. If you are not the registered owner of the vehicle, you represent that you have the right to authorize towing and service of the vehicle.

We reserve the right to decline or discontinue service at any time if conditions at the scene make safe performance of the service impossible, if the vehicle cannot be safely loaded or moved, if road or weather conditions prevent safe operation of our equipment, or if we determine that continuing the service would create unreasonable risk to our personnel, other drivers, or the vehicle itself.

Towing Asheville provides pricing estimates before dispatching service whenever possible. Quoted prices are based on the information provided during the dispatch call, including vehicle type, location, service type, and destination. Prices are subject to revision if the actual conditions at the scene differ materially from what was described — for example, if a vehicle cannot be rolled when it was represented as rollable, or if a pickup location requires off-road recovery not mentioned during the call.

Any revisions to the quoted price will be communicated to the Customer before additional work is performed. You have the right to decline additional work and pay only for work already completed.

Payment is due in full upon completion of service unless other arrangements have been made in writing in advance. Accepted payment methods are communicated by dispatch at the time of service. Failure to pay for completed services may result in applicable legal remedies under North Carolina law, including liens on the vehicle where permitted.

Our driver will note visible pre-existing damage to your vehicle before loading or beginning service. We strongly recommend that you also note and photograph any visible damage before service begins. You are responsible for informing the driver of any known mechanical conditions, modifications, or sensitivities that could affect how the vehicle should be loaded or transported.

Towing Asheville is not responsible for damage to vehicles that results from conditions that were present before our arrival, from mechanical failures that occur during or after towing due to pre-existing damage or wear, from vehicle modifications that affect loading requirements not disclosed before service, or from conditions inherent to the vehicle's non-operational state.

Our liability for any damage that occurs during towing or roadside service, if established, is limited to the actual cost of repair of the specific damage caused, not to exceed the fair market value of the vehicle at the time of service. We are not liable for consequential, incidental, or indirect damages of any kind.

If your vehicle is towed to a storage facility, daily storage fees will accrue from the time the vehicle is delivered to that facility. Storage rates will be communicated at the time of service. You are responsible for retrieving your vehicle within the timeframe specified at the time of towing. Vehicles not retrieved within the applicable period may be subject to additional fees or other actions permitted under North Carolina law.

North Carolina General Statute Chapter 20 governs the towing and storage of motor vehicles in this state. Where our Terms conflict with applicable NC law, NC law controls.

Towing Asheville operates primarily within Buncombe County, North Carolina, including the city of Asheville and surrounding communities. Service outside this primary area, including long-distance towing, is available by arrangement and subject to availability and additional pricing based on distance.

We operate 24 hours a day, 365 days a year, but actual response times and equipment availability may vary based on demand, weather, road conditions, and other factors. Quoted arrival times are estimates, not guarantees. We are not liable for delays caused by conditions outside our control, including but not limited to traffic, accidents on I-40, I-26, or other roads in the Asheville area, severe weather, road closures, or dispatch equipment issues.

When requesting service, you agree to provide accurate information about the vehicle's location, make, model, condition, and the nature of the problem. Inaccurate information that affects the service we provide or the equipment we dispatch may affect pricing and may limit our liability for any resulting issues.

You agree to ensure that the vehicle and pickup location are reasonably accessible to our equipment. You agree not to interfere with the loading, transport, or unloading of the vehicle. You agree to be present or have an authorized representative present at the pickup location within a reasonable time of the truck's arrival. Failure to be present may result in a trip charge even if service is not completed.
